Terms & Conditions of Membership
1. MEMBERSHIP
Membership shall be open to any Hong Kong individual over 18 years
old, residing in Hong Kong and accepting the primary objects of the
Club, which is to promote and to develop knowledge about the Sport
of Motor Sport, the History of Motor Sport and the skill of Car Racing.
2. APPLICATION
To apply for Membership all future Members have to fill out the
standard application form of Sideways (Driving Club). Once accepted
the new members ID Card number shall become his/hers membership no.
Identification of members is by membership and ID Card or recognition.
The member shall produce his/hers membership card and ID Card upon
request of club management or staff. In the event of a lost or stolen
membership card, the member should contact the club regarding re-issue
of a replacement card. The member shall have the capacity to enter
into this Agreement. If the member is of limited capacity, he/she
represents that he/she has obtained the consent of his/her statutory
representative prior to entering into this agreement. The nature
of the membership under this agreement is exclusive. The rights of
membership shall be enjoyed only by the member, and the membership
is non-transferable.
3. MEMBERSHIP FEE
There is no fee for Membership and admission to the club is free
of charge.
4. DURATION OF MEMBERSHIP
After a positive decision from the management the applicant will
become a Member of the Club for the duration of one year, commencing
from the date of the application.
5. EXPIRATION
The membership will automatically expire after one year unless the
Club renews the Membership for the next year.
6. REJECTION OF APPLICATION
The management of the Club reserves its right to reject applications
without stating reasons for such rejection to the applicant.
7. REVOCATION OF MEMBERSHIP
The management can revoke Membership with immediate effect due to
gross misconduct of the Member by informing the Member of such revocation
in writing.
8. SPECIAL APPLICATIONS
The management reserves the right to offer membership by invitation.
The Management reserves the right to invite non members for trial
runs. In this case the Terms & Conditions of Membership and the
Membership Rules and Guidelines shall apply.
9. IMPORTANT PRE SIGNING NOTICES TO THE MEMBER
The Member acknowledges that he/she has received a copy of this
Agreement. This Agreement may be used for admittance into the club
facilities until member receives his/her membership card.
You are given sufficient time to review this Agreement and request
for clarifications from club management, thus please do not sign
this Agreement until you have read and understood all the terms and
conditions of membership. Also, you have the right to amend the terms
of this Agreement with the written consent of Sideways (Driving Club).
By signing this Agreement, you understand that your membership begins
immediately, and you have entered into a legally binding relationship
between yourself and Sideways (Driving Club). All rights and obligations
set out in this Agreement will be in force from the date of signature.
The respective rights and obligations of membership are set forth
herein and in the Membership Rules and Guidelines. In signing this
Agreement, the member acknowledges his or her understanding and acceptance
of the rights and obligations. Sideways (Driving Club) reserves the
right to amend its Rules and Guidelines from time to time and where
appropriate. The member shall ask the club management for clarification
of any questions or concerns prior to signing this agreement. A hard
copy of this Agreement, of the Terms and Conditions of Membership,
of the Club House Rules and the Disclaimer of Liability are displayed
on the club premises.
10. MEMBERSHIP RULES AND GUIDELINES
CLUBHOUSE RULES
Members have to comply with the Clubhouse-rules :
(1) General
Every member or guest binds them selves to abide by the rules of
Sideways (Driving Club) as defined by management, whose decision
in the interpretation of the Rules and Regulations shall be final
and binding.
(2) To follow the orders of the Club management at all times.
(3) To take care that other Members are not disturbed by their behavior.
(4) No Member shall occupy or use any portion of the club for any
immoral or illegal purpose.
(5) Members shall avoid creation of excessive noise in the Clubhouse
and the surrounding area.
(6) Upon leaving the premises , members shall act quietly to not
disturb the residents in the area.
(7) Tidiness
Members and guests are required to keep the Club facilities tidy
at all times.
(8) Guests
Members are encouraged to bring guests into the Club. Members are
responsible for their guests behavior. All Terms and Conditions
of Membership shall also
apply for guests and the Member shall notify their guest in respect to the
Disclaimer of Liability.
(9) Minors are only allowed onto the premises accompanied by adults/parents
who are Members.
(10) Liquor
Liquor can be served between 12 noon and 11pm. No Liquor shall be supplied
for consumption outside these hours. Intoxicated Members shall not stay on
the Club premises and no alcohol shall be served to intoxicated Members.
No person shall be allowed to become drunk on the club premises, nor shall
liquor
be supplied to any person who is drunk.
(11) The club has no opening hours and is operated by appointment only. Members
are required to call or e-mail in advance to make a booking.
(12) Food and Beverages
Food and Beverages are not permitted onto the Simulator Podiums or in the
Simulators themselves. Members are required not to take Beverages outside
the licensed
premises.
(12) The main door shall be kept closed at all times. No drinks shall be
taken outside the club premises or consumed outside the main door.
(13) Smoking
The club is a non-smoking environment.
(14) Simulators
Use of simulation equipment is against hire charge only. Prices and Rates
are displayed at reception. Booking is necessary. No Member shall occupy
or use
any portion of the club for any immoral or illegal purpose.
(15) Foot ware
No shoes are allowed inside the Simulators. Members are required to drive
in socks only.
(16) Library
Members can borrow books from the library. The books shall remain on the
premises. They shall be treated with utmost care. They shall be returned
to club staff
or management before the members departure.
(17) Breakages
Breakages must be reported to staff immediately. The club may require that
the member or guest responsible make payment for repair/replacement if damage
was due to carelessness or abuse.
(18) The club is licensed for no more than 29 people including staff at any
one time.
(19) Payment
Members shall settle their bills before leaving the club premises.
II. DISCLAIMER OF LIABILITY
1. The use of the facilities of Sideways (Driving Club) may involve
the risk of injury to a member him/herself or the members or guests,
whether caused by a member or someone else. The member understands
and voluntary accepts this risk. The member agress that Sideways
(Driving Club). Will not be liable for any injury including, without
limitation, personal, bodily, or mental injury, economic loss,
or any damage to the member, or his/her relatives resulting from
the acts of anyone using the facilities or acts of Sideways (Driving
Club) employees or agents. The member agrees to bear responsibility
for all liabilities and damages arising from any injury, including,
without limitation, bodily or mental injury, economic loss, or
any damages to any other member caused by a deliberate or negligent
action of the member him/herself. If any claim is made by anyone
based on any injury, loss or damage described here, which involves
the member or his/her guest, the member agrees to (i) defend Sideways
(Driving Club) against such claims and pay Sideways (Driving Club)
for all expenses including legal fees relating to the claim and
(ii) indemnify Sideways (Driving Club) for all liabilities to the
member and his/her spouse, unborn child, relatives, or anyone else,
resulting from such claims.
2. Sideways (Driving Club) is not responsible for any items lost
or stolen on its premises for any reason what so ever. The member
is solely responsible for safekeeping their personal belongings on
the premises.
3. To participate in video game racing simulations you have to be
18 years old or older, minors must be accompanied by parents.
4. You shall only drive if you are in excellent health and you shall
not drive if you suffer from high blood pressure, heart problems,
sight problems, breathing problems or other debilitating illnesses.
5. You shall not drive if you are on medication.
6. You shall not drive if you are pregnant.
7. Epilepsy Warning :
a. A very small percentage of individuals may experience epileptic
seizures when exposed to certain patterns or flashing lights, exposure
to certain light patterns or backgrounds on a television screen
or while playing video games may induce an epileptic seizure in
these individuals, certain conditions may induce undetected epileptic
symptoms even in persons who have no prior history or seizures
or epilepsy. If you , or anyone in your family, has a epileptic
condition, consult your physican before playing. If you experience
any of the following symptoms while playing a video game : dizziness,
altered vision, eye ormuscke twitches, loss of a wareness, disorientation,
any involuntary movement, or convulsions, immediately discontinue
use and consult your physican before resuming play.
b. All persons participating in video game racing simulation in Sideways
(Driving Club) do so entirely at their own risk. Temporary membership
can be withdrawn at any time without further notice at the discretion
of Sideways (Driving Club).
c. The undersigned shall indemnify Sideways (Driving Club), the instructor
(if any), the manufacturer of the simulator and the video game producing
companies, against all liabilities arising from the video game racing
simulator driving causing personal injury or death to themselves
or others.
